UTAHVERSE - Booking Terms & Conditions
1. Agreement to Terms
By booking or participating in any UTAHVERSE event, retreat, experience, or related product or service (collectively, an “Event”) operated by BGCJ LLC, a Utah, USA company (“UTAHVERSE,” “we,” “us,” or the “Tour Operator”), you (“you,” “your,” or “Participant”) agree to be bound by these Booking Terms & Conditions (“Terms”).
By completing a booking, you confirm that you have read, understand, and accept these Terms. If you book on behalf of other participants, you confirm that you have authority to accept these Terms on their behalf and that all participants agree to be bound by them.
2. Booking Contract
A binding contract is formed once UTAHVERSE issues written confirmation of your booking after receipt of the applicable deposit or full payment.
Please review your confirmation carefully and notify us immediately of any errors or omissions. Participant names must exactly match the names shown on passports or official identification.
You agree to provide complete, accurate, and up-to-date information at all times.
3. Special Requirements
Any special requirements (including medical, dietary, or accessibility needs) must be disclosed at the time of booking.
While UTAHVERSE will make reasonable efforts to accommodate disclosed requests, accommodation cannot be guaranteed due to destination limitations, supplier availability, or the nature of certain activities. Some activities may be unsuitable if mobility is limited.
Dietary needs and food allergies must be disclosed in advance; however, UTAHVERSE cannot guarantee that all dietary restrictions can be met. Special requests do not form part of the contract and UTAHVERSE is not liable for any failure to fulfill them.
4. Mandatory Travel Insurance & Trip Cancellation
Travel insurance is mandatory. You must carry valid travel insurance with a minimum coverage of USD $200,000 for medical expenses, emergency evacuation, and repatriation for the full duration of your Event.
Because hotel fees and other Event-related costs are non-refundable, your insurance must also cover trip cancellation and interruption to protect against unforeseen events that prevent your participation.
Trip Cancellation by UTAHVERSE:
- In the rare event that UTAHVERSE cancels an Event due to the effects of Covid-19, SARS-CoV-2, or other serious public health risks, participants will be offered credit toward a future UTAHVERSE Event.
- If an Event is cancelled due to under-enrollment, participants will receive a full refund of amounts paid to UTAHVERSE.
- UTAHVERSE’s financial responsibility is limited to amounts actually paid by the participant(s) and does not extend to other costs incurred, including travel, flights, or personal arrangements.
- UTAHVERSE is not obliged to refund any costs in full or in part if weather conditions, safety concerns, or other factors make it impossible or unsafe to complete the Event.
You are strongly encouraged to include coverage for delays, loss or damage to belongings, and other travel-related risks. Insurance is not included in the Event price and must be arranged independently at your own cost.
You are responsible for ensuring your insurance covers the destinations, duration, and activities included in your booking, and for notifying your insurer of the nature of the Event to ensure adequate coverage.
5. Pricing, Taxes & Promotions
All prices are quoted in USD and include applicable taxes unless stated otherwise.
Prices will not increase once full payment has been received. Promotional or reduced pricing applies only to new bookings and cannot be applied retroactively.
6. Required Information
You must provide all requested information by the deadlines specified, including passport details and any documents required for flights, permits, or services.
Failure to provide required information may result in cancellation of all or part of your booking, with applicable cancellation fees. UTAHVERSE is not responsible for costs, losses, or fees arising from incomplete, late, or incorrect information provided by you.
7. Airfare
International and domestic airfare is not included unless explicitly stated in the Event description.
8. Travel Documents
You are solely responsible for obtaining and carrying all required travel documents, including a passport valid for at least six (6) months beyond your final travel date, visas, permits, vaccination records, and insurance documentation.
UTAHVERSE does not provide official advice on travel documentation and is not responsible for denied entry, delays, or losses due to insufficient or incorrect documents.
9. Flexibility & Unused Services
You acknowledge that Events may require flexibility. Routes, schedules, accommodations, activities, and transportation may change due to circumstances beyond UTAHVERSE’s control.
No refunds or reimbursements will be issued for unused services, missed activities, or early departures once travel has commenced, including removal due to breach of these Terms.
10. Third-Party Suppliers
UTAHVERSE works with independent third-party suppliers, including hotels, transport providers, guides, and activity operators (“Third Party Suppliers”).
UTAHVERSE is not responsible for the acts or omissions of Third Party Suppliers. Their services are subject to their own terms, conditions, and liability limitations under applicable laws and international conventions.
UTAHVERSE is not liable for loss of enjoyment, distress, inconvenience, or damages caused by parties outside its direct control.
11. Changes
Changes by UTAHVERSE:
UTAHVERSE may modify itineraries or services when reasonably required for operational, safety, or logistical reasons. Such changes do not entitle you to compensation.
Changes by You:
All changes requested by you are subject to availability, approval, and applicable fees. No changes are permitted within ten (10) days of departure. Cancellations are governed by the applicable cancellation policy.
12. Optional Extras
Optional Extras are activities or services not included in the Event price. Participation is voluntary and at your own risk.
UTAHVERSE bears no responsibility or liability for Optional Extras and any associated injury, loss, or damage remains the sole responsibility of the third-party provider.
13. Force Majeure
UTAHVERSE is not liable for any loss, delay, injury, damage, or expense caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, acts of war, terrorism, government actions, labor disruptions, mechanical failures, or severe weather (“Force Majeure”).
14. Images & Marketing
You consent to the use of photographs and video taken during Events in which you may appear. You grant UTAHVERSE a perpetual, royalty-free, worldwide license to use such media for marketing, promotional, and commercial purposes without compensation.
15. Privacy
Personal data is collected and used in accordance with UTAHVERSE’s Privacy Policy, available on our website. By booking, you consent to such use.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain valid and enforceable.
17. Governing Law
These Terms are governed by the laws of the State of Utah, USA. Any disputes will be subject to the exclusive jurisdiction of the courts located in Salt Lake City, Utah.
18. Amendments
UTAHVERSE may update these Terms at any time. Updates take effect ten (10) days after publication on the UTAHVERSE website. Continued participation constitutes acceptance of the updated Terms.
